This Policy for the collection and processing of personal data (hereinafter referred to as the Policy) was developed to explain the approach of Bekem Trade LLP (hereinafter referred to as Bekem Trade) to working with personal data collected and processed on the website www.bkmt.kz.

Applicable right — the law to be applied in the territory of the state in which the collection and/or processing of personal data is carried out; for the purposes of the Policy, the applicable law is the law of the Republic of Kazakhstan.


CPU (Processor) — natural or legal person, public authority, agency or other body, which processes personal data on behalf of the controller.

1.1 Bekem Trade collects and processes the following categories of personal data:

  • Basic data: surname; first name; patronymic (if any); date and place of birth; phone number; e-mail address; country and city of residence.
  • Marketing data: request and subscription data; last name; first name; email address; company name; jurisdiction data; preferred language and economic sector.
  • Information about applicants: surname; first name; patronymic (if any); phone number; e-mail address; country and city of residence; work experience; education; additional materials of the applicant;
  • Device data: IP address; unique device identifier (UDID); cookies; location data; website usage data; other device-related data;
  • Data of potential suppliers and buyers: company name; contact person data; position; phone number; email address; location; website address of the potential supplier and buyer; additional materials of the supplier and buyer.

1.2  Bekem Trade does not collect and process special categories of personal data, which include: race and ethnicity; political views; religious and philosophical beliefs; trade union membership; genetic and biometric data; data on health, sex life or sexual orientation.

2. Sources of personal data collection

2.1 Bekem Trade may collect personal data from the following sources:

  • From the subjects who provide their personal data when carrying out any form of interaction with the Bekem Trade website (www.bkmt.kz ), including when subscribing to newsletters, filling out feedback forms, sending requests to join the Bekem Trade team.

  • Providing articles, reviews and other materials of an informational and/or analytical nature in the field of goods and services to the Company with which the Subjects are associated, which, from the point of view of Bekem Trade, may be of interest to the company.
  • Providing the Company with which the Subjects are associated with other information related to the activities of Bike Trade, as well as any other information that, from the point of view of Bekem Trade, may be of interest to the Company.
  • Provision of services to the Company or related Entities.
  • Conducting negotiations between the Company (related Entity) and Bike Trade related to the sale of goods or the provision of their services to the Company (related Entities).
  • Improving the quality of services provided by Bekem Trade to the company and/or related Entities;
  • For the purposes established by Applicable Law, in particular, if the collection and processing of personal data is necessary to fulfill the obligations of Bekem Trade provided for by Applicable Law, to carry out the activities of law enforcement agencies, courts and enforcement proceedings, including to protect the rights and legitimate interests of Bekem Trade.

4. Collection of personal data

4.1 Bekem Trade collects personal data on the website when performing the following actions:

  • Subscribing to receive news or marketing newsletters.
  • Making inquiries about the goods and services of Bekem Trade.
  • Sending requests to join the Bekem Trade team.
  • Interacting and working with the website using cookies and other technologies for collecting and tracking information on any browser or device.
  • Using the services provided by Bekem Trade on the website.

5. Collection and processing of personal data without the consent of the subject

5.1 Bekem Trade collects and processes personal data without the consent of the subject, if necessary:

  • To fulfill the contract concluded between the Subject and Bike Trade, or if Bekem Trade, at the request of the Subject, takes the necessary measures to conclude the contract.
  • To fulfill Bekem Trade's obligations provided for by law.
  • To protect the essential interests of the Subject or other natural person.
  • To protect the rights or legitimate interests of Bike Trade or another person, including with the assistance of law enforcement agencies, courts and bailiffs.
  • In other cases established by applicable law.

5.2. In cases where the collection and processing of personal data without the consent of the subject is permitted by Applicable law, the Subject has the right, referring to the grounds that arose in a particular situation, at any time to request the suspension of such collection and processing until Bekem Trade demonstrates the legitimacy of the interests for the protection of which the collection and processing is carried out. It is allowed to collect and process personal data using automation tools.

6. Transfer of personal data

6.1 Bekem Trade may transfer personal data to the following categories of recipients:

  • Processors and service providers for Bekem Trade who perform functions on behalf of Bekem Trade and in accordance with the instructions of Bekem Trade in order to achieve the goals set out in the Policy.
  • Suppliers, contractors, subcontractors and third-party organizations in order to provide or receive any type of services.
  • Law enforcement and regulatory authorities.

6.2 Bekem Trade transfers personal data only if the following conditions are met:

  • With the consent of the Subject or any other legitimate and legitimate reason for the transfer of personal data.
  • When providing the person to whom the personal data is transferred with an adequate level of protection and security of personal data.
  • If the transfer complies with the applicable law of the jurisdiction from which the personal data is transferred and to which it is transferred, as well as other regulatory legal acts that may be applicable during the transfer.

7. Cross-border transfer of personal data

7.1 Bekem Trade may transfer personal data to the territory of other States by decision of a court or arbitration body, as well as any decision of an administrative body of a third country and/or an international organization, if 1 such decision is mandatory for the execution of Bekem Trade in accordance with the norms of applicable law, including applicable international agreements, or 2 such data transfer is permitted by applicable law and is carried out in compliance with its requirements.

7.2 Bekem Trade may carry out cross-border transfer of personal data for the purposes provided for in this Privacy Policy, as well as if the transfer of personal data is required for the performance of a contract at the request of the Subject or pre-contractual events, as well as for the conclusion of a contract or its execution concluded in the interests of the Subject.

7.3 Bekem Trade may carry out cross-border transfer of personal data for other purposes and in other cases with the consent of the Subject, obtained after explaining to him the possible risks associated with such transfer.

8. Withdrawal of consent

8.1 If the Subject has given his consent to the processing of his personal data, the Subject has the right to withdraw his consent free of charge at any time. This applies to cases where the Subject wants to opt out of receiving marketing messages from Bekem Trade.

8.2 If the Subject makes a request, Bekem Trade has one month to respond to the Subject. If the Subject wants to exercise any of these rights, he must contact Bike Trade by e-mail: info@bkmt.kz.
